Watford Borough CouncilLicence - street cafeA licence is required to use a public street, road or place for the sale of food and drink and for the placing of tables, chairs and other furniture outside a restaurant or cafe for patrons to use whilst consuming food and drink. Pavement licences are granted for up to a year at a time for pavement cafes to be held on the public highway. Licences are not needed if the furniture is to be placed on private property but planning permission may be required. Before submitting an application form, applicants must obtain the permission of the freeholder of the premises. Copies of the application form and scale plans of the proposed area must be sent to the Council, the highways authority (Hertfordshire County Council), the police and the fire service. The annual application fee and a copy of a current public liability insurance certificate must be sent to the Council. A public notice must also be displayed on the premises for at least 28 days so that passers-by can see it. As part of the consultation process, the Council will write to frontagers (adjoining properties) and other nearby premises for comments about the proposed application. Licences are granted subject to a number of detailed conditions relating to safety, nuisance and litter management. Licences may be suspended to allow for other activities (such as street works) to take place, and may be revoked at any time if the conditions are not being met. Putting furniture on the highway in breach of a licence or without having a licence in force may be treated as an obstruction or unlawful street trading by the Council, the highways authority or the police.
