Housing benefit - appeals

If you disagree with a decision about your housing benefit you have the right to appeal but there are time limits. You should put any appeal in writing, and keep copies of your letters.

If you disagree with the decision the council has made you can:

  • Ask for an explanation - you can either do this verbally or in writing

  • Ask for the decision to be reviewed - the council will look at your claim again. This should be done within one month from the date of the decision that you do not agree with.

  • Appeal to an independent tribunal - they will then look at the circumstances and make a decision. Your appeal should be sent to us first and should be in writing. You can ask someone to help you but the letter should be from you (or signed by you). You should do this within one month from the date of the decision that you do not agree with.

You can ask for a decision to be reviewed or you can make an appeal outside this month deadline but you will need to say why you did not contact us sooner.

We cannot accept an Appeal that has been made more than 13 months after the decision that you do not agree with.

it may help you to get advice from a solicitor or contact the Citizens Advice Bureau on tel: 01923 234949.
